IRDAI DIRECTS INSURERS TO SHARE STATUS OF CLAIMS WITH
POLICYHOLDERS
The insurance regulator
has directed insurers to share status of claims at various stages of their
processing to ensure a fair and transparent claim settlement process. This has
to be implemented by the insurers from July 1, 2019. When it comes to claims,
there is a need to make available a tracking mechanism for policyholders so as
to enable them to know the status of their claims, the Irdai said on Wednesday.
In case of health insurance claims, where third party administrators (TPAs) are
involved in rendering claims services, the insurance companies have to make
sure that status of claims of policyholders are notified to them at every stage
of the claim sttlement process. However, the consent of policyholders has to be
obtained by insurance companies for notifying the services rendered by the
insurers and no other unsolicited information can be sent to the policyholders.
The insurance companies also have to create a unique claims reference number
and notify the policyholders electronically via their registered mobile number
or through an e-mail as soon as the claim intimation process begins. Moreover,
the Irdai has said that the unique claims reference number should also enable
tracking of the claim of the claimant through the portal or website, or apps of
the insurance company, or any authorized electronic means. The regulator has
also asked the insurers to collect mobile numbers and e-mail ids of
policyholders during the sale process or later to provide better service to the
policyholders. However, it is up to the policyholders if they want to provide
their mobile numbers and e-mail ids. It cannot be made mandatory. Moreover, all
insurers (life, general and health) have to send all communications regarding
policy issuance, servicing of insurance policies to their policyholders. In
general insurance, information about policy issuance like acceptance, rejection
of proposals, renewals, lapse intimations and premium reminders have to be sent
to policyholders. For life insurance, bonus accrued in life insurance
participating policies, value of ULIP polices, and all other information that
has a bearing on servicing of insurance policy have to be provided by insurers
either in the form of a letter, e-mail, or SMS. As far as health insurance is
concerned, all communications such as issuance of ID card are either sent by
the third party administrators or the insurers themselves should be
communicated by the insurance company to the policyholders. Care may be taken
to use simple language that is easy to read and understand in these communications.
Wherever feasible, the communications may be in regional or local language of
the place of residence of the policyholder/claimant, besides English/Hindi,
said Irdai.

MUTUAL FUNDS CLOSE FY19 WITH 11.41% RISE IN AUM AT RS 23.8

Mutual funds closed the
year with an 11.41 per cent rise in their total assets under management at Rs
23.80 trn in the year to March, from Rs 21.36 trn in the previous year,
according to the industry data released Wednesday. On a monthly basis, AUM grew
2.73 per cent from Rs 23.16 trn in February. The industry saw net outflows of
Rs 22,357 crore in March as against net outflows of Rs 20,083 crore in
February, the agency said. On a monthly basis, net outflows in the liquid/money
market category came more than doubled to Rs 51,343 crore from Rs 24,509 crore
in February. Inflows in equity funds (including equity-linked savings schemes)
grew more than 120 per cent month-on-month in March to Rs 11,756 crore. Net
inflows in the other ETF category came in at Rs 10,540 crore in March 2019 as
against net inflows of Rs 5,234 crore in February, the report showed. However,
net outflows in the balanced category came in at Rs 3,181 crore as against net
outflows of Rs 1,077 crore in February.

UP RERA DIRECTS BANKS TO STRICTLY COMPLY WITH ESCROW ACCOUNT
PROVISIONS
Cracking the whip against
diversion of funds by unscrupulous builders from ongoing realty projects, the
Uttar Pradesh Real Estate Regulatory Authority (UP RERA) has directed
commercial banks to strictly comply with escrow account provisions The watchdog
took cognisance that some builders/promoters were not complying with the
statutory provisions of the Real Estate (Regulation and Development) Act, 2016
and withdrawing funds without submitting the requisite certificate, which UP
RERA chairperson Rajive Kumar has termed as, grave violation of the mandatory
provisions of the Act. UP RERA has sent letters to the zonal/state heads of all
42 scheduled public and private sector banks and also the Director General of
Institutional Finance Directorate for being more vigilant in the operation of
escrow accounts maintained by promoters/developers and the compliance of
Section 4 (2) (I) (D) of Real Estate (Regulation and Development) Act, 2016.
According to UP RERA secretary Abrar Ahmed, escrow accounts of 2,651 realty
projects registered with RERA were being operated in 962 bank branches based in
UP and some outside the state too. Section 4 (2) (I) (D) of the Act stipulates
that 70% of the money collected from the allottees from time to time be
deposited in a separate bank account to cover the cost of construction and
land. However, the promoter could withdraw funds only after being certified by
an engineer, an architect and a chartered accountant that the said withdrawal
was in proportion to the percentage of completion of the ongoing project. The
Authority had also noticed that some banks, especially those which had
sanctioned loans to the promoter, arbitrarily adjusted the entire amount
deposited in such accounts against the outstanding loan instead of transferring
70% of the money collected to the escrow account for the purposes of
construction and payment of the land cost. UP RERA has notified the banks’
zonal/state heads that if the branches under their jurisdiction failed to
comply with the standing provisions the matter would be brought to the notice
of their top management apart from the union banking secretary for further
action. Recently, UP RERA had also issued notices to Ansal Properties &
Infrastructure Limited (Ansal API) for alleged fraud and diversion of more than
Rs 600 crore under different sections of the RERA Act, 2016 pertaining to its
four projects in Lucknow encompassing 3,151 units. The show cause notice was issued
after the forensic auditor investigated 91 projects of Ansal API over last
three months for alleged financial misappropriation. The auditor claimed that
Ansal projects were found to be in breach of RERA compliances, managing
separate accounts and a possible diversion of over Rs 600 crore to other
purposes.

Medium Enterprises (MSME) sector is poised to create up to 1 crore jobs in next
4-5 years through measures aimed at improving the market competitiveness of
MSMEs, said a report. The report by Nomura Research Institute (NRI Consulting
& Solutions) on the country's MSMEs said that dedicated focus on developing
MSMEs in various clusters like rubber, metal, plastics, textiles etc. can
create additional 75 lakh -1Cr. employment opportunities in next 4-5 years
through partial substitution of imports. The manufacturing sector in India
needs to shoulder the dual responsibility of accommodating the shift of labour
from agriculture and also cater to the added labour force, it added.

INDIA SHOULD BOLSTER CAPITALISATION OF GOVT-OWNED BANKS TO
TACKLE NPAS: IMF
Noting that the level of
non-performing loans in India remains high the International Monetary Fund has
favoured bolstering the level of capitalisation of some banks, particularly
government-owned banks. Anna Ilyina, said on Wednesday that bolstering the
level of capitalisation was one of the recommendations of the Financial Sector
Assessment Programme (FSAP) for India. The level of non-performing loans (NPLs)
in India remains high. And the level of the capitalization of some banks,
particularly government-owned banks, should be bolstered, said Ilyina.There
were some steps that were taken by the authorities to boost capital buffers in
banks and also to improve governance in state-owned banks that have had some
positive impact, Ilyina said. The institutional mechanisms for resolution and
the recognition of NPLs are, of course, an extremely important part of the
process of cleaning up the banking system of non-performing loans, she said
adding that the authorities should continue working along these lines. Tobias
Adrian, said that there continues to be a high stock of Non-performing Assets
in India. There has been some progression, but we would welcome further
progress on the non-performing assets in India, he said responding to a
question on Indian banking system.

The Reserve Bank of India
(RBI) may take more time to examine the Lakshmi Vilas Bank (LVB) and India
Bulls Housing Finance Ltd (IHFL) merger deal, an official source said on
Wednesday. It (LVB-IHFL merger) may take time for examination, a source said,
adding the central bank may seek more information also on the proposed merger
after going through the proposals from the entities. The All India Bank
Employees' Association (AIBEA) had urged RBI Governor Shakthikanta Das not to
allow the proposed merger of LVB with IHFL. The central bank should instead
merge LVB with one of the public sector banks, AIBEA General Secretary C.H.
Venkatachalam had said in a letter to the RBI Governor.

RBI IMPOSES RS 1 LAKH PENALTY ON LUCKNOW-BASED CO-OP BANK
The Reserve Bank Wednesday
said it has imposed a penalty of Rs 1 lakh on UP Postal Primary Co-operative
Bank, Lucknow for violation of norms regarding shifting of its branch. The RBI
had issued a show-cause notice to the bank, in response to which the lender
submitted a written reply. After considering the facts of the case and the
bank's reply in the matter and personal hearing, the Reserve Bank of India
(RBI) came to the conclusion that the violation was substantiated and warranted
imposition of penalty. The Rs 1 lakh penalty has been imposed on the
co-operative bank for violation of RBI Instructions/Guidelines for shifting of
its branch without obtaining prior approval from RBI, the central bank said. On
Tuesday, the RBI had imposed certain restrictions on The Mudhol Co-operative
Bank, Bagalkot district, Karnataka till its financial position improves.

GOVT RETAINS GPF INTEREST RATE AT 8% FOR Q1 FY20
The government has
retained the interest rate for General Provident Fund (GPF) and other related
schemes at 8 per cent for the April-June quarter. The rate is in line with that
of Public Provident Fund. The interest rate on GPF was at 8 per cent in the
January-March quarter of 2018-19. It is announced for general information that
during the year 2019-20, accumulations at the credit of subscribers to the GPF
and other similar funds shall carry interest at the rate of 8 per cent with
effect from April 1 to June 30, 2019, a Department of Economic Affairs
notification said.

an order dated 10 April 2019 on 36 Rafale Procurement Case. In the Review
Petitions, the petitioners have relied upon the documents, some of which could
not have been placed in public domain. The Central Government raised an
objection that while considering Review Petitions, the said documents may not
be considered as they are classified In the Order passed by the Supreme Court,
the Court has decided to look into the documents also while deciding the Review
Petitions. The Review Petitions are pending and are yet to be heard. It is
reiterated that the petitioners are using documents with the intention to
present a selective and incomplete picture of internal secret deliberations on
a matter relating to National Security and Defence. The documents presented by
the petitioners are failing to bring out how the issues were addressed and
resolved and necessary approvals of the competent authorities taken. These are
selective and incomplete presentation of the facts and records by the petitioners.
Government had provided the requisite information as desired by the Hon’ble
Supreme Court to the Court and also to the petitioners as per directions of the
Court and in the manner prescribed by the Court. Government also provided all
records and files as required by CAG. The main concern of the Government is

Comptroller and Auditor General (CAG) has already cleared the deal and a

pending. All that the court has said is that even a wrongly procured document

Wednesday extended the deadline for submission of initial bids for stake
purchase in the ailing airline to April 12. SBI Capital Markets, which issued
Expression of Interest (EoI) document on April 8, has extended the deadline for
submission of initial bids to April 12. Potential bidders can send their
queries till April 11. The qualified bidders will be expected to submit their
respective binding bid(s) latest by April 30, 2019 subject to the terms set out
under the bid document, SBI Capital Markets said in a notice posted on its
website. While all soft copies of the EoIs are required to submitted by the EoI
due date, the hard copies may be submitted by April 16, 2019, the notice said.

said in a set of clarifications issued regarding the bid document. Jet Airways
is grappling with acute financial crunch and the SBI-led consortium of domestic
lenders are implementing a debt resolution plan. Bidders are required to
provide the solvency certificate on their letterhead and certified by managing
director/ full time director / chief executive officer of the bidder or a
person holding an equivalent position in the bidder, it noted.

The Indian government may
have to make a series of major changes at the top of the nation's civil service
if Prime Minister Narendra Modi is re-elected to a second term in May,
according to multiple sources in the administration. At least eight senior
bureaucrats in the prime minister's office have either sought a transfer to
other departments or plan to take premature retirement, three government
officials said. The officials, from the prime minister's office, the home
(interior) ministry and the foreign ministry, declined to be named because of
the sensitivity of the subject. Two of them said they too are keen to be
transferred to state capitals or to other jobs. They said officials in several
ministries were trying to move, but did not have a number There are about 25
senior civil servants working in the prime minister's office, which under Modi
has become the single most powerful department in government. The three
officials said the reasons for wanting out are almost all the same Many top
bureaucrats complained about two aspects of the Modi administration – their
inability to influence government policy as it is largely controlled and set by
the prime minister and a small group of ministers and advisers, and the
demanding work schedule they face. The sense of partnership is missing, Modi
and his ministers do not have an organic relationship with the bureaucrats,
said the civil servant in the home ministry. To be sure, some other major
governments around the world often face a series of departures and changes,
especially when a first term morphs into a second term. Also, just because an
official talks about quitting doesn’t mean they will. But in India, officials
in the prime minister's office are hand-picked for loyalty and tend to stay if
the administration is re-elected. Modi's BJP-led alliance is tipped to win a
slim majority in the April-May general election, pollsters say. Senior
bureaucrats said Modi's top-down approach, and his orders to work on public
holidays, to demand they submit details of their assets and to clean their own
workplaces at the start of a five-year cleanliness campaign in 2014, has
widened the gap between the civil servants and the nation’s leader. Amit Shah, in
a closed door meeting attended by two ministers in February said bureaucrats
continued to suffer from communist romanticism, a reference to the alleged
influence of the left-leaning Congress opposition party on the bureaucrats. The
ministers, who spoke to Reuters, declined to be identified. For some of the
5,000 or so mandarins who run the Indian government, its state-owned entities,
as well as administration at state government level, Modi's style of leadership
has been a jolt. Many of these top officials have received a Western-style
education at India's elite universities or schools overseas and are
uncomfortable with the ruling party's right-wing Hindu nationalism and Modi's
rough-hewn approach to governance. While getting into the Indian Administrative
Service (IAS), is incredibly hard – only 1 out of about 4,500 who took the
civil service exam got selected in 2018 – traditionally once someone got in
they had a job for life with few risks of ever getting fired. An IAS job - one
of the most sought after in India - bestows huge power as well as cheap housing,
a car with a driver and other perks, leave for government-paid foreign study,
and often the chance for plum positions in business or government consultative
work after retirement. There is also a handsome pension. But such conditions
can also breed complacency and a lack of 'can do' behaviour, according to
Indian politicians and civil servants. They say there are plenty of Sir
Humphreys in New Delhi, referring to a character in the British TV comedy
series Yes Minister about how top officials in Whitehall stall government
policies they don't agree with. In particular, there is deep resentment in the
top echelons of the Indian civil service over the interference in government by
the Rashtriya Swayemsevak Sangh (RSS), the Hindu right-wing umbrella group of
which the BJP is a part, these officials said. RSS functionaries have had a
major role in successfully lobbying for big changes at the Reserve Bank of
India, for example, leading to last December's resignation of its governor and
his replacement with an official who is considered more loyal to Modi,
officials said. RSS figures also criticise Modi for not having enough
professionally trained experts in place to implement some of his more
controversial policies. The country needs a professional administration for
economic development and can't depend on generalists, said Ashwani Mahajan, the
economic wing of the RSS that has campaigned against some bureaucrats. Last
year, Modi proposed bringing in at least ten professionals from the private
sector into the civil service at the joint secretary level, but the plan has
still to be implemented, and is facing strong resistance from civil servants.
Joint Secretaries are two rungs below full Secretaries, the top civil servant
in a ministry. A senior finance ministry official said major policy decisions
including demonetisation, Modi's decision to wipe out high-denomination bank
notes without warning in 2016 and to hastily launch a goods and services tax
that hit millions of small businesses and jobs, were examples of political
decisions that didn't get enough airing among officials before being
implemented. Both are thought to have hurt jobs growth, economists say. There
is a wider concern in the civil service about India being ruled by a Hindu
nationalist party that some see destroying the country's previous tolerant and
secular nature. But the hours are as much of a concern to some. I am looking
out for other opportunities and have even requested for a transfer because it
is almost impossible to work for 12-13 hours every day, even during weekends,
said a senior official working with Modi since 2014.

RENEWABLE ENERGY SECTOR ATTRACTS FDI WORTH $7.48 BILLION SINCE
APRIL 2000
According to a report by
the India Brand Equity Foundation (IBEF), the country's renewable energy sector
attracted foreign direct investments (FDI) worth $7.48 billion between April
2000 and December 2018. The IBEF report pegs new investments in clean energy
space worth $11.1 billion in calendar 2018, sourcing data from the Ministry of
New & Renewable Energy (MNRE) and leading consultancy KPMG. The green
energy sector boasted 28 deals and grabbed a 27 per cent share of the merger
& acquisition (M&A) deals in the power sector valued at $4.4 billion in
2017. The government allows a 100 per cent FDI under the automatic route for
projects of renewable power generation and distribution provided they comply
with the provisions of The Electricity Act, 2003. India aims to achieve 175 Gw
of nameplate capacity in renewable energy generation by 2022. The envisaged portfolio
includes 100 Gw of solar capacity addition and 60 Gw in wind power capacity. Globally,
India is the third largest solar market and has the fourth highest installed
wind power capacity. As on December 2018, Tamil Nadu, Gujarat and Maharashtra
had finalised wind power bids of 500 Mw each. Replacing coal-fired plants with
renewable installations is expected to save around Rs 54,000 crore annually for
the country on account of shrinkage in power costs.

INDIA HAS SCOPE FOR REDUCING UNTARGETED FOOD, FERTILISER

There is a lot of scope in
India for reducing untargeted food and fertilizer subsidies and enhancing
revenue administration, the IMF has said. When one looks at some of the
populist proposals announced by political parties during this election season,
the important thing is to look at the benefits but also look at the costs and
to look at the details, Paolo Mauro, told. Certainly, when one looks at the
case of India, there is a lot of scope for reducing untargeted food and
fertilizer subsidies, and for enhancing revenue administration, including for
the GST, which was a transformational positive reform. But, again, even there,
improved tax compliance would be a priority, Mauro said. Mauro said in India's
case, the priority continues to be gradual fiscal consolidation because the
gross general government to Gross Domestic Product (GDP) ratio is at about 70
per cent. You also have a very rapid growth rate. The economy is growing in
excess of 7 per cent, and the objective there is to make sure that that growth
is inclusive and it filters down to poverty reduction, he said.

RBI NEEDS TO FORTIFY FOREX RESERVES FURTHER BY $20 BILLION:

An additional $20 billion
of foreign exchange (FX) reserves which will take India’s overall holdings to
$430 billion, would provide an extra, useful cushion in a world of increased
financial volatility, according to a research report by HSBC. This would be a
halfway climb to the record $450 billion reserves India held in early 2018. The
RBI’s new FX swaps, of course, help in this regard. But, when possible, it may
be a good idea to continue with outright dollar purchases alongside, suggested
Pranjul Bhandari. The study found that India faces challenges on two metrics —
short-term external debt cover (reserves/ short-term debt ratio) and short-term
external debt plus current account deficit cover (reserves/ STD + CAD ratio).
We scale up FX reserves until India fully meets those criteria as well. That
number, as per our analysis, is $430 billion, about $20 billion more than
current levels, said HSBC’s economic research team. Pointing out that India had
reserves of $450 billion in early 2018, the report said the subsequent
draw-down in reserves helped to anchor the country’s external position during
the time of heightened global financial volatility. Increasing reserves
halfway, from $410 billion now, to $430 billion may thus offer some benefits in
the future. Reserve Bank of India’s new scheme of buying dollars from banks for
three years and offering them rupees in return (via USD/INR buy/sell auctions),
HSBC said this move will inject liquidity into the banking system, while
raising foreign exchange reserves. One can argue that they subtract an equal
amount from the forward book, because they have a maturity of three years, and
therefore, on net, do not lead to any increase in overall foreign exchange
reserves. Yet, because three years is a sizeable time (enough to potentially
ride out a full Fed tightening-cycle), this accretion to spot reserves is
meaningful from an adequacy perspective, in our view, said the report.

DOT REVIEWS BSNL 2G SPECTRUM EXPIRY TERM
The department of telecom
(DoT) is reconsidering the actual term for the expiring second-generation or 2G
airwaves allocated to state-controlled Bharat Sanchar Nigam Limited (BSNL)
which had been awarded a license in 2000. The government has earlier refused
any consideration beyond 2020. The DoT is evaluating the 2G spectrum that was
in-principle allocated to BSNL in 2000, and it had launched services after two
years in 2002. So, going by the real service launch, BSNL would need a renewal
of 2G airwaves in 2022 or 2023, Anupam Shrivastava told. BSNL had received a
letter of intent (LoI) for the allotment of 2G spectrum in the 900 Mhz spectrum
band administratively in 2000 but it had actually launched commercial services
in October 2002, while a letter of approval was granted a year later in 2003.
Considering the initial approval to BSNL in 2000, the department was adamant
that radio waves would expire in 2020, after completion of a 20-year term,
while the state-run telco has sought a review. However, the Centre has to
change its firm stand, following the recent restlessness from the 1.76 lakh
BSNL employees including top management as well as their groups blaming the
Narendra Modi-led government for not allowing the much-needed revival of the
financially-stressed public sector telco. The fourth-largest telco has asked
renewal across the 22 telecom circles where it offers 2G telephony services on
the 900 Mhz frequency band with 6.2 Mhz of the spectrum. Meanwhile, the DoT has
sought a legal opinion from the Attorney General (AG) on whether the
state-owned MTNL could be allowed spectrum extension.

BSNL, MTNL ASSET SALE PROCEEDS TO CLEAR DEBT, FUND VRS
The proceeds of
monetisation of assets of the state-run telecom majors BSNL and MTNL will be
used to service the debt of these public sector undertakings, (PSUs) and fund a
vountary retirement scheme (VRS), as per a decision of the government. This was
decided at last week's meeting of the Prime Minister's Office (PMO) and the
Department of Telecom (DoT) chaired by the PMO Principal Secretary Nripendra
Mishra on the matter of revival of these PSUs. DoT to pursue and lead the
phased monetisation of assets of BSNL and MTNL. DIPAM will actively facilitate
the entire process and the monetisation plan should be finalised by the Niti
Aayog CEO, according to the minutes of that meeting. The proceeds of
monetisation should inter alia be utlised for funding the VRS and servicing the
debt of the two PSUs, it further said.

CENTRE CAN'T WITHHOLD DOCS UNDER RTI CITING NATIONAL SECURITY,
SAYS SC
The Supreme Court
Wednesday said the Centre cannot withhold documents from disclosure under the
RTI Act citing national security if it is established that retention of such
information produces greater harm than disclosing it. The observation was made
by Justice K M Joseph in his 38-page separate but concurring judgement in which
the Supreme Court allowed the plea relying on leaked documents for seeking
review of its judgement on the Rafale fighter jet deal with France. It
dismissed the government's preliminary objections claiming privilege over them.
Justice Joseph said the RTI Act through Section 8(2) has conferred upon the
citizens a priceless right by clothing them with the right to demand information
even in respect of such matters as security of the country and matters relating
to relation with foreign state. No doubt, information is not be given for the
mere asking. The applicant must establish that withholding of such information
produces greater harm than disclosing it, Justice Joseph said. He said the
premise for disclosure in a matter relating to security and relationship with
foreign state is public interest. Right to justice is immutable. It is
inalienable. The demands it has made over other interests has been so
overwhelming that it forms the foundation of all civilised nations. The
evolution of law itself is founded upon the recognition of right to justice as
an indispensable hallmark of a fully evolved nation. The preamble to the constitution
proclaims justice -social, economic or political, as the goal to be achieved.
It is the duty of every State to provide for a fair and effective system of
administration of justice. Judicial review is, in fact, recognised as a basic
feature of the Constitution, he added. The judge said that Section 8(2) of the
RTI Act manifests a legal revolution that has been introduced in that, none of
the exemptions declared under sub-section(1) of Section 8 or the Official
Secrets Act, 1923 can stand in the way of the access to information if public
interest in disclosure overshadows, the harm to the protected interests.
Justice Joseph said that Section 24 of the RTI Act also highlights the
importance attached to the unrelenting crusade against corruption and violation
of human rights. The most important aspect in a justice delivery system is the
ability of a party to successfully establish the case based on materials.
Subject to exceptions it is settled beyond doubt that any person can set the
criminal law into motion. It is equally indisputable however that among the
seemingly insuperable obstacles a litigant faces are limitations on the ability
to prove the case with evidence and more importantly relevant evidence. He said
that a citizen can get a certified copy of a document under the RTI Act even if
the matter pertains to security or relationship with a foreign nation if a case
is made out. Justice Joseph said if such a document is produced before the
court then surely a claim for privilege cannot be made by the government. It is
clear that under the Right to Information Act, a citizen can get a certified
copy of a document under Section 8(2) of the RTI Act even if the matter
pertains to security or relationship with a foreign nation, if a case is made
out thereunder. If such a document is produced surely a claim for privilege
could not lie, Justice Joseph said. The judge said that though there is no
unqualified right to obtain information in respect of matters under Section
8(1)(a) of the RTI Act, the court cannot be wholly unaffected by the new regime
introduced by Parliament under the RTI Act on the question regarding a claim
for privilege. It is pertinent to note that an officer of the department is
permitted under the RTI Act to allow access to information under the Act in
respect of matters falling even under Section 8(1)(a) if a case is made out
under Section 8(2). He said the context for material being considered by the
court is relevancy, and there can be no dispute that the manner in which
evidence is got -- that it was procured in an illegal manner -- would not
ordinarily be very significant in itself. The judge said that the three
documents in question have been published in 'The Hindu' and it is true that
they have not been officially published but the correctness of the contents per
se of the documents are not questioned. The case does not strictly involve in a
sense the claim for privilege as the petitioners have not called upon the
respondents to produce the original and as already noted the state does not
take objection to the correctness of the contents of the documents. The request
of the respondents is to remove the documents from the record. In the writ
petition out of which the review arises the complaint is that there has been
grave wrong doing in the highest echelons of power and the petitioners seek
action inter alia under the provisions of Prevention of Corruption Act, Justice
Joseph said.

A week before the first
phase of elections, ruling BJP has taken a big lead in advertising on Google
and its affiliated platforms such as YouTube with an ad spend of Rs 1.21 crore,
while its main rival Congress has spent only Rs 54,100, the search engine said.
Google, in a report on political advertisement across its platforms - Google,
YouTube and partner properties, said Rs 3.76 crore was spent by advertisers
since February 19. Our goal is to provide greater transparency in political
advertising on Google, YouTube, and partner properties. This report includes
information about Lok Sabha election ads that feature or are run by a political
party, a political candidate, or a current member of the Lok Sabha, it said.
Chandrababu Naidu-led TDP was the biggest ad spender with a total expenditure
of Rs 1.48 crore His ad spend was by two firms - Pramanya Strategy Consulting
(Rs 85.25 lakh) and Digitant Consulting (Rs 63.43 lakh). BJP spent Rs 1.21
crore on advertisements during this period. TDP's rival YSR Congress of Jagan
Reddy was a close third with an ad spend of Rs 1.04 crore. Congress spent Rs
54,100 on Google platforms. The remaining spend was by Ethinos Digital
Marketing (RS 1.56 lakh), Pammi Sai Charan Reddy (Rs 26,400), Harshnath Human
Services (Rs 6,300), Jaskaran Dhillon (Rs 5,400), Vidooly Media Tech (Rs 1,300)

POPULISM RISES: INDIA NEEDS A NEW CONSENSUS ON GROWTH AND
OPPORTUNITY
India has so far been
spared the kind of populist revolt that’s testing many rich Western
democracies. It’s far from immune, however. This country of more than 1.3
billion people is about to begin its long process of going to the polls (the
results won’t be known until late next month). The politicians seeking election
ought to recognize that many of the conditions for a similar upheaval are in
place — and that the best way to avoid it is to promote growth and opportunity
through economic reform. Sadly, the campaigns to date have put their focus
elsewhere. Prime Minister Narendra Modi has reminded voters of his tough recent
stand against Pakistan, promising to guard India against enemies within and
without. The opposition Congress party has pitched itself as the savior of the
poor, pledging to provide a minimum basic income for the country’s lowliest
citizens. Neither side has had much to say about economic growth, without which
most other ambitions are meaningless. India’s demographic dividend — its
growing population is one of the youngest in the world — won’t last forever. By
one estimate, the support it gives to economic growth could begin to wane as
early as 2030. If India fails to generate jobs with livable wages and
possibilities for advancement, its poorly educated and disproportionately male
youth will be ripe for the kind of authoritarian appeals that have polarized
other societies. Modi triumphed five years ago by promising to shift India’s
economy into a higher gear. His record has been mixed. Most laudably, he
ushered in two broad, bold reforms: a nationwide goods-and-services tax and a
new bankruptcy code. Despite teething problems, these will ultimately help to
make the economy more prosperous. New road-and-rail infrastructure, especially
in rural areas, will do the same. Other new programs, from building toilets to
opening bank accounts and providing cooking-gas cylinders for poor families,
have directly improved people’s lives. Better access to capital is needed, too.
Private investment is low because the state-owned banks, which account for 70
percent of the banking sector, aren’t lending. Efforts to recapitalize them and
improve their management have fallen short. The government needs to encourage
growth in privately owned banks and greater reliance on a well-regulated
private capital market. In general, when it comes to the economy, India’s
government should try harder to do less.

COMMERCE MINISTRY ASKS HEALTH MINISTRY TO FRAME LAW TO BAN
MANUFACTURE, SALE OF E-CIGARETTES
The commerce ministry has
asked its health counterpart to frame law banning manufacture and sale of
e-cigarettes in the country as in the absence of a domestic legislation, it
would not be possible to put a blanket ban on its imports sources said. The
health ministry had asked the commerce ministry to issue a notification banning
import of Electronic Nicotine Delivery Systems (ENDS), including e-cigarettes
and flavoured hookah. Without banning domestic sale and manufacturing of ENDS
through a law, it will be an infringement of global trade norms to put an
import ban, one of the sources said. In March, the Central Drugs Standard
Control Organization also directed all drug controllers in states and UTs not
to allow the manufacture, sale, import and advertisement of ENDS, including
e-cigarettes and flavoured hookah, in their jurisdictions. Over 1,000 doctors
from 24 states and three UTs in April this year urged Prime Minister Narendra
Modi to enforce a ban on ENDS before it becomes an epidemic in India,
especially among the youth.

India's trade ministry
says it cannot impose a ban on electronic cigarette imports as there is no
legal basis for doing so, an internal government memo shows, in a boost for those
looking to tap into the country's growing vaping market. This comes amid
repeated calls for a ban from the country's health ministry, which urged states
and government agencies last year in an advisory to step up efforts to halt
sales and imports, warning vaping devices pose a great health risk. The country
has 106 million adult smokers, second only to China, making it a lucrative
market for firms such U.S.-based Juul Labs and Philip Morris International that
plan to launch e-smoking devices in the country. India's Jubilant group, one of
whose units has the franchisee for Domino's Pizza and Dunkin' Donuts outlets in
the country, is already exploring importing Juul's vaping device, a company
letter shows. Halting imports of e-cigarettes into India will be against
multilateral commitments with the World Trade Organization, according to the
internal government memo dated March 18. The country must first prohibit local
sales through federal regulations that can stand the scrutiny of law, the memo
adds. Once that is done, the Directorate General of Foreign Trade (DGFT) can
announce an import ban, the memo said. As of now, the health ministry's
advisory cannot be a legal basis for a ban, the trade ministry, which has the
power to impose import bans, said in the memo that is not yet public.

Courts. The Collegium recommended the appointment of Justice Bhat after noting
that the office of the Chief Justice of the Rajasthan High Court has fallen
vacant after the recent transfer of Justice Pradeep Nandrajog to Bombay High
Court. Therefore, appointment to that office is required to be made. Justice S
Ravindra Bhat is the senior-most Judge from Delhi High Court and is functioning
in that High Court since his elevation. Having regard to all relevant factors,
the Collegium finds Justice S Ravindra Bhat suitable in all respects for being
appointed as Chief Justice of the Rajasthan High Court. The Collegium resolves
to recommend accordingly. It also recommended appointment of Justice Menon
noting that the office of the Chief Justice of the Chhattisgarh High Court has
fallen vacant recently after resignation of Justice A K Tripathi, Chief Justice
of the High Court. The Collegium said it finds Justice Menon suitable in all
respects for being appointed as Chief Justice of the Chhattisgarh High Court
and consequent upon the proposed appointment, there will be two Chief Justices
from Kerala High Court. Having regard to all relevant factors, the Collegium
finds Justice A K Mittal suitable in all respects for being appointed as Chief
Justice of the Meghalaya High Court, it said. Following the proposed
appointment there will be two Chief Justices from the Punjab & Haryana High
Court, which serves two States and is the third largest High Court in the
country, with sanctioned strength of 85 Judges, the Collegium said. Upon the
proposed appointment there will be three Chief Justices from the Allahabad High
Court, which is the largest High Court in the country with the sanctioned
strength of 160 Judges, it said. There will be two Chief Justices from Bombay

CERC'S FINAL TARIFF REGULATION FOR FY20-24 LARGELY IN LINE
WITH DRAFT GUIDELINES
The Central Electricity
Regulatory Commission's tariff regulation for FY2020 to FY2024 is largely in
line with the draft guidelines India Rating and Research (Ind-Ra) said
Wednesday. The CERC had brought the draft tariff regulation in the December
2018 for a block period of five years from April 1, 2019 to March 31, 2024. The
final the CERC guidelines for the FY2020 to FY2024 block period are favourable
for power generators, as they are largely in line with the draft guidelines,
Ind-Ra said in a statement. The CERC has maintained status quo on two of the
key parameters: return on equity at 15.5 per cent and debt:equity at 70:30, it
added. Ind-Ra believes the increase in operations and maintenance expenses will
offset the negative effect of the tightened working capital norms, leading to
no significant change in the AFC. The regulator continued with the change in
the interest rate on working capital to one year marginal cost of funds based
lending rate (MCLR) + 350bp (basis point) as against the SBI base rate + 350bp
in the FY2015 to FY2019 guidelines, the agency said.

INDIA’S STEEL DEMAND TO GROW BY OVER 7% THIS FISCAL, FY21
The Indian Steel
Association expects steel demand to grow 7.2 per cent for next two fiscal due
to relatively slow growth in major consuming sectors such as automotive and
consumer durables. India’s steel consumption is forecast to cross 100 million
tonnes this year, it added. The World Steel Association had estimated steel
demand in India to touch 103 million tonnes this year against 96 mt logged in
2018. It would further grow up to 110.2 mt in 2020. The steel demand from
consumer durables sector is expected to normalise after a strong growth logged
last year. Among consumer durables air-conditioner, washing machine and
refrigerator sales were boosted by cut in GST rates. The growth in both
automotive and consumer durables sectors are expected to slow down to seven per
cent each for next two years from 16 per cent and 22 per cent clocked last
year.

NO POLITICAL ADS ON SOCIAL MEDIA AHEAD OF POLLS? THANK

If you are in a state or
city that is going to polls today (Thursday), you would most likely find no
political ads cluttering Facebook news feed or playing on your Youtube video,
thanks to the Election Commission (EC). But political posts or opinion by
family members or friends are going to be on display. However, political posts,
videos or pictures tagged ‘sponsored’ in the last few weeks will not be shown
to you 48 hours before your city or state goes to vote. For the ads, we will be
proactive in enforcement. This means, people in a state going to polls will not
see any political ads on the platform, said an employee of one of the
technology platforms. About a month ago, while announcing the model code of
conduct, the EC said that Section 126 of the Representation of the People Act
(RPA), which places an embargo on publishing and airing content that is likely
to affect the election 48 hours before polling, would also be applicable to
social media companies. Following several rounds of discussion with the EC,
technology firms had committed to cooperate with the commission and have
updated their advertisement policies for political advertising in the country.
Facebook, Google and Twitter have strengthened their authentication mechanisms
for entities running political ads, which includes a media certification and
monitoring committee certificate from the poll panel. For an ad, Facebook has
made available granular data in which gender of persons who saw it and the
number of views it got are being shown. All they have to do is silence the ad
in that region. It is possible for social media firms to block these ads for
specific regions, said an industry executive who did not wish to be named. He
added that most political advertising was seen on Facebook and Google among
large platforms, while Twitter’s ad rates are very high. Social media platforms
will also take down content that violates the model code of conduct, upon
receiving a legal notice or a request from the Election Commission.

DOORDARSHAN SEEKS RAHUL GANDHI INTERVIEW AMID ALLEGATIONS OF

Doordarshan has asked
Congress president Rahul Gandhi for an interview in order to give space to all
political views in the face of allegations of bias. The state-run broadcaster
was ticked off by the Election Commission of India on Tuesday for lack of
balanced political coverage. The Opposition has said it was giving preferential
treatment to the government and the ruling party. Shashi Shekhar Vempati is
learnt to have written to the Congress party seeking an interview with Gandhi
for DD News and Rajya Sabha TV, which he also runs, so that the principal
opposition party may put forth its views. Doordarshan is run by Prasar Bharati.
Vempati sought an hour-long joint interview for both channels at the earliest
in an April 4 letter. As the biggest exercise of democracy, the Lok Sabha
elections, has been announced, it will be a great privilege for DD News and
RSTV to conduct a joint interview with the Congress president Shri Rahul
Gandhi, so that the principal opposition party may put forth its views to the
citizens of India, Vempati wrote. The interview could be at a time and place of
convenience for the Congress president. After assessing Doordarshan’s response,
the EC on Tuesday wrote to the information and broadcasting ministry that the
airtime coverage given to various political parties is disproportionate and not
balanced. The EC asked the ministry to direct DD News to desist from extending
any preferential or disproportionate airtime coverage in favour of any party
and to ensure balanced coverage of all political parties. The ministry met
Prasar Bharati officials on Tuesday and asked them to put in place ‘a robust
system for adherence to the model code of conduct. It has also said that while
the EC directions were specific to DD News, all Prasar Bharati arms including
All India Radio and Doordarshan must adhere to the code. A committee will be
set up immediately to ensure that the model code of conduct is complied with in
all news and other coverage.

UN REPORT INDICATES IMPROVEMENT IN THE QUALITY OF INDIA'S
HEALTHCARE SYSTEM
India's population grew at
an average annual rate of 1.2 per cent between 2010 and 2019 to 1.36 billion,
more than double the annual growth rate of China, according to a report by the
United Nations Population Fund. India's population in 2019 stood at 1.36
billion, growing from 942.2 million in 1994 and 541.5 million in 1969. In
comparison, China's population stood at 1.42 billion in 2019, growing from 1.23
billion in 1994 and 803.6 million in 1969. China's population grew at an
average annual rate of 0.5 per cent between 2010 and 2019, the report said.
According to the report, in India, total fertility rate per woman was 5.6 in
1969, dropping to 3.7 in 1994 and 2.3 in 2019. India recorded an improvement in
life expectancy at birth. The life expectancy at birth in 1969 was 47 years, growing
to 60 years in 1994 and 69 years in 2019. Giving a snapshot of India's
population composition in 2019, the report said 27 per cent of the country's
population was in the age bracket of 0-14 years and 10-24 years each, while 67
per cent of the country's population was in the 15-64 age bracket. Six per cent
of the country's population was of the age 65 and above. Indicative of the
improvement in the quality of India's health care system, the report noted that
Maternal Mortality Ratio (MMR) in the country dropped from 488 deaths per
100,000 live births in 1994 to 174 deaths per 100,000 live births in 2015.
Director of UNFPA Geneva Monica Ferro said the figures were worrisome and it
was essential to raise the level of consent and access to vital health services
for millions of women around the world. Highlighting positive changes in the
last half-century, the report shows that in 1969, the average number of births
per woman was 4.8, compared with 2.9 in 1994, and 2.5 today. About 35 million
women, girls and young people will need life-saving sexual and reproductive
health services this year, as well as services to address gender-based
violence, in humanitarian settings, it warns. Every day, more than 500 women
and girls including in countries with emergency settings, die during pregnancy
and childbirth, due to the absence of skilled birth attendants or emergency
obstetric procedures, Ferro said.

ENRON-DABHOL POWER PROJECT: SUPREME COURT CLOSES CASE OF
ALLEGED CORRUPTION
The Supreme Court Thursday
closed the case of alleged corruption involving politicians, bureaucrats and
corporates in the Enron-Dabhol power project, taking note of the inordinate
delay in the case that was filed in 1997. A bench comprising Chief Justice
Ranjan Gogoi and Justices Deepak Gupta and Sanjiv Khanna allowed the plea of
Maharashtra government to close the case. The USD 3 billion mega power project
was set up in Maharashtra by US-based Enron and its associates Dabhol Power
Corporation in 1996 after signing of Power Purchase Agreement (PPA) with
Maharashtra State Electricity Board (MSEB) in 1993. The apex Court had in 1997
admitted the petition of the Centre for Indian Trade Union (CITU) challenging a
Bombay High Court order upholding the Power Purchase Agreement (PPA) and issued

COMBINATION DRUG MARKET DECLINES 56% IN MARCH AS GOVT CLAMPS
DOWN
With the government
clamping down on combination drugs the latest market data shows that in March,
the fixed-dose combination (FDC) market declined 56.4 per cent when the non-FDC
market showed a growth of 9.2 per cent and single molecule drugs grew 9.4 per
cent. An FDC drug is one that contains two or more active ingredients in a
fixed-dosage ratio. Last year, the government banned over 340 'irrational' FDCs
that were found to pose health risks to patients. More FDC drugs are under the
scanner at the moment which may also come under the ban. As a result,
pharmaceutical companies have pared their exposure to FDCs and are also
restricting the launch of new combination drugs. Before the ban came mid last
year, we had braced for the same and weeded out FDCs from our domestic
portfolio. Henceforth we have been cautious about launching new combination
drugs. As such the government is studying the efficacy of another 940 FDCs and
therefore, there is a sense of uncertainty in this market, said the chief of a
leading pharmaceutical player. Data from market research firm AIOCD AWACS
reflects the mood in the market. In March the market related to FDCs saw a
decline of 56.4 per cent. The price component for the FDCs saw a 1.3 per cent
growth while volumes shrunk by 57.9 per cent, AIOCD AWACS said. In comparison,
the non-FDC market grew 9.2 per cent while single molecules saw a 9.4 per cent
growth in March. In terms of moving annual turnover (MAT), which reflects the
last twelve months data, the FDC market saw a 20.6 per cent decline in value
terms at Rs 641.6 crore while the unit sales fell by 16 per cent. The non-FDC
segment saw a 10 per cent growth in value terms to Rs 62,517 crore while the
single molecule market grew 9.6 per cent to Rs 67,347 crore. The overall Indian
pharmaceutical market (IPM) grew 9.6 per cent to Rs 1.3 trillion. Sudarshan
Jain, that represents the research-based pharma companies in India pointed out
that the FDC market captured in the AIOCD AWACS data refers to those that have
come under the scanner. There are many approved FDC drugs too. Cardiovascular
and some other therapies would see more combination drugs. However, for any new
drug to be launched, one has to take regulator approval, which is stringent
now. The ban on the 'irrational' FDCs is in the interest of the patient, he
said. In March 2016, the ministry of health and family welfare had implemented
a ban on 349 FDCs based on recommendations of the Chandrakant Kokate committee
that found these drug combinations to be irrational and posing health risks. In
December 2017, the Supreme Court referred the matter to the Drug Technical
Advisory Board (DTAB) for a fresh review after drugmakers challenged the ban.

India is witnessing a
listless growth in electricity demand, possibly signaling more slowdown in
Asia’s third-largest economy. Electricity requirement from distribution
utilities in February rose 1.3 percent from a year earlier and barely changed
from January’s 1.1 percent, the weakest growth in two years, according to the
power ministry’s Central Electricity Authority. Data for power generation, a
proxy for demand, showed the weakness continued into March. The trend points to
a lack of appetite among factories and commercial firms -- who consume about half
the country’s electricity -- ahead of government data on industrial production
for February that’s due Friday. Uncertainty about the outcome of a national
election beginning Thursday, weak domestic demand and a global slowdown have
clouded India’s economy. Economic growth slowed to 6.6 percent in the three
months to December, the weakest pace in six quarters. The International
Monetary Fund Tuesday cut the nation’s growth outlook for this year to 7.3
percent from 7.5 percent seen in January. The industry is not growing at a fast
pace, said Devendra Kumar Pant. All leading indicators suggest sluggishness in
industrial activities will continue for some time. India’s core infrastructure
sector, which constitutes 40 percent of total industrial production, grew 2.1
percent in February, marginally improving from January’s 19-month low of 1.8
percent when electricity generation and production of refinery products
contracted. While factory output data for March, which is published with a
one-month lag, is due in May, early indicators point to a steepening slowdown.
Local passenger vehicle sales have contracted for five straight months to
March, while exports growth has been sluggish.

Taiwanese contract
manufacturer Foxconn will begin from July the commercial production of iPhone X
range of smartphones for Apple from its 160-acre factory off Chennai, people
aware of Foxconn’s India plans told. Foxconn will begin with the iPhoneX
(range) from the Chennai plant. The plans are to step up production capacity
and diversify to even higher models going forward, said an official privy to
the company’s plans, on conditions of anonymity. Sustained increase in
manufacturing will depend on, among other factors, the continuation of a
favourable incentive regime into the next government, the official said. The
company began its India manufacturing journey through another Taiwanese company
Wistron, which had started with the iPhone SE from its factory near Bengaluru two
years ago and later advanced to iPhone 6S model. Wistron now makes iPhone 7, a
sign analysts foresee as a bump-up in local manufacture of multinational
technology companies keen on the Indian market. Around 290 million handsets
were assembled in India in 2018 up from 58 million in 2014, according to data
from the Indian Cellular and Electronics Association. In the short-term, the
Differential Duty and the Phased Manufacturing Programme worked as far as
import substitution is concerned. Now the challenge is to move from 290 million
to 500 million phones and then to one billion by 2025, Pankaj Mohindroo, said.

SC IMPOSES RS 20 LAKH FINE ON WEST BENGAL GOVERNMENT FOR

The Supreme Court on
Thursday imposed a fine of Rs 20 lakh on the West Bengal government for shadow
banning Bangla film 'Bhobishyoter Bhoot' based on political satire. It also
directed the state government to pay damages to theatre owners who were
restrained from screening director Anik Dutta's 'Bhobishyoter Bhoot' (Ghost of
the Future) from almost all multiplexes and single screen theatres earlier in
the year. The money will be given to the producer and theatre owners by the
state, a bench headed by Justice D.Y. Chandrachud said. The apex court also
noted that the order clearly was in the violation of the fundamental right of
free speech and expression.

CITIZENSHIP BILL PUTS A LOT AT STAKE IN THE ONLY LOK SABHA
SEAT IN NAGALAND
With only one seat at
stake, the contentious citizenship amendment bill has emerged as one of the
major issues in Nagaland. On the one hand, the Bharatiya Janata Party (BJP),
which is part of the ruling alliance at both the centre and in the state,
supports the citizenship amendment bill. On the other, its main ruling partner,
the Nationalist Democratic Progressive Party (NDPP), doesn’t believe that the
bill is an issue for the polls. The bill seeks to grant citizenship to
immigrants from Pakistan, Bangladesh and Afghanistan, who face religious
persecution in their countries. While releasing its manifesto on Monday, BJP
reiterated its commitment to enact the bill. NDPP’s Tokheho Yepthomi, the
alliance’s candidate for the sole Lok Sabha seat in Nagaland, however,
dismisses the bill being an issue. The citizenship amendment bill was passed in
the Lok Sabha but it was not introduced in the Rajya Sabha because of
widespread protests across the states of the North-East. Although individuals
talk about the citizenship amendment bill, it will lapse in the Rajya Sabha, he
told Mint on Friday. The next government will decide whether to move it or
leave it, said Yepthomi. Yepthomi is seeking re-election, having won the
February 2018 bypoll after chief minister Neiphiu Rio vacated the seat to
contest the state elections. Rio formed NDPP in 2017 after a coup against him
in the Naga People’s Front (NPF). He came to power with BJP’s support, despite
NPF emerging as the largest political party in the state, with the highest
representation in the assembly. Yepthomi’s main opposition is Congress
candidate K.L. Chishi, a former BJP member and chief minister, and a veteran in
Nagaland’s political arena who rejoined the Congress earlier this year. In
Nagaland’s 60-member state legislature, NPF has 27 seats, while NDPP has 17
seats and BJP 12. On 11 April, there will also be a byelection to the
Aonglenden assembly constituency, with NDPP and Congress in the fray. Rahul
Gandhi held a rally last week, reportedly drawing a crowd of about 25,000
people. Gandhi said that if the Congress were voted to power, it would not pass
the controversial citizenship amendment bill. One of the main issues is the
citizenship amendment bill, which was passed in the Lok Sabha. It will again
come back, said Congress’ Chishi. Political parties from the North-East believe
that the bill was at cross purposes with the National Register of Citizens,
which seeks to wean out illegal Bangladeshi immigrants. Further, the BJP
government wants to introduce a uniform civil code. It is dangerous. Once it is
enshrined in the Constitution, the special protection to Nagas that Article 371
(A) provides will go. During British rule, the Naga hills under Assam were left
as an excluded area. They wanted Nagas to remain on their own, without
interference. They didn’t want outsiders to dilute the Naga way of life. I
don’t know what kind of speeches they give in the mainland. Here, as per the
atmosphere that prevails in each state, the leaders speak on those lines only,
said NDPP’s Yepthomi.

NO HINDUTVA ORIENTATION IN FOREIGN POLICY
Shortly before the 2014
elections, Narendra Modi — at that time practically a novice in foreign affairs
— stated in an interview that my Hindutva face will be an asset when dealing
with foreign affairs with other nations. This statement might have been
indicative of a strict ideological, assertive foreign policy posture that put
India first in all its future engagements. Yet, an analysis of five years of
National Democratic Alliance’s (NDA’s) foreign policy only reveals changes in
direction and scope, but no traits of strict adherence to a genuine Hindutva
ideology, or any ideology for that matter. In the BJP Election Manifesto 2014,
the party did not use the term Hindutva foreign policy and dealt with
international affairs in three pages only. The wish to reboot and reorient
foreign policy was expressed as the strengthening of Indian soft power or the
establishment of a new web of alliances. Taking a bird’s eye view of select
bilateral and multilateral foreign policy developments from 2014-19, it is
obvious that Prime Minister Modi has been much more visible and outspoken and
travelled more than any of his predecessors. The inviting of Modi’s South Asian
counterparts to the swearing-in ceremony in May 2014 hinted at a strong focus
towards India’s neighbours and created expectations of closer bilateral and multilateral
cooperation. The Maldives, despite Indian overtures, still ratified a free
trade agreement with China (as did Pakistan) and with Nepal, despite Modi’s
initial outreach and support after the earthquake in 2015; the country’s new
federal constitution of 2015 led to a dramatic worsening of bilateral ties. All
in all, countries in India’s immediate neighbourhood have been successfully
incorporated into China’s One Belt One Road (OBOR) initiative, with an adequate
Indian response still at large. Overall, with respect to its immediate
neighbourhood, the Modi government has followed a course of policy continuity,
except for Pakistan. As for the South Asian Association for Regional
Cooperation (SAARC), there has only been one summit in the past five years, and
progress has stalled especially in the face of Indo-Pak enmity. India
subsequently did not attend the Belt and Road Forum, citing grave concerns over
the building of the China-Pakistan Economic Corridor. However, Modi did hold an
informal summit with President Xi Jinping in Wuhan 2018 to work on better ties
with China. In multilateral settings, India started to engage in the
quadrilateral (Quad), a grouping that also includes the US, Japan, and
Australia. Despite repeated attempts, India was eventually denied entry into
global governance platforms such as the Nuclear Suppliers’ Group or the United
Nations Security Council (UNSC). However, on India’s appeal, the UN introduced
worldwide International Yoga Day (June 21). The latter, especially, was heralded
as a new sign of global Indian outreach. And, finally, connecting with the
Indian diaspora around the world has been an important objective for the NDA
government. What is more, India’s new assertive posture towards both Pakistan
and China and a host of new strategic partnerships — such as the ones with
Saudi Arabia and UAE — are actually indicators of a new foreign policy
pragmatism. A Hindutva foreign policy, faced with a myriad of geopolitical and
geo-economic necessities, as it was in the past five years, simply did not lend
itself to becoming a new Indian foreign policy orientation or grand strategy.
Instead, pragmatism has clearly eclipsed Hindutva.

RAFALE DEAL: BJP ACCUSES RAHUL GANDHI OF CONTEMPT OF COURT
The BJP on Wednesday said
he attributed to the Supreme Court what it had never said in its order on the
Rafale deal. Nirmala Sitharaman said, The Congress president probably doesn't
read even half a paragraph of the court's order, but here, by saying that the
court has said 'chowkidaar chor hai' it is verging on contempt of court. The
president of a party which has been in power for so many years has shown his
frustration by attributing words to the apex which were not uttered, she said.
The minister added that the court order was limited to whether it should

Rs one crore in cash from a BMW car in southwest Delhi's Vasant Vihar,
officials said on Wednesday. Police said in view of the Lok Sabha elections,

Britain wants to end the
divorce blame game. The government has announced plans to introduce no-fault
divorces so separating couples no longer have to blame one another for the
breakdown of a marriage. David Gauke said Tuesday that the government will introduce
legislation after a public consultation revealed broad support for change.
Until now, couples have had to prove misconduct such as adultery by one partner
or live apart for a fixed period before they could divorce. The proposed
changes would only require the couple to declare that their marriage had
irretrievably broken down.

NATIONAL PARTIES ONCE AGAIN DEMONSTRATE GENDER BIAS IN
FIELDING CANDIDATES
Are political parties
using women members just for gathering crowd in public meetings and increasing
headcount during rallies? It seems so, according to Archana Jha, National
Program Coordinator at Centre for Social Research, New Delhi. Considering low
percentage of tickets distribution to female candidates by almost all political
parties, a marathon campaign was recently undertaken by the National Alliance
for Women’s Reservation Bill. The members of the Alliance visited several
political parties’ offices to demand at least 33 per cent tickets for female
candidates in the upcoming elections. The political parties which were hailed
as model parties by the Alliance in terms of ticket distribution to women were
All India Trinamool Congress (AITC) which gave 41 per cent tickets to women
candidates and Biju Janata Dal (BJD) which reserved 33 per cent. Jha, who led
the delegation of women’s groups to various political party offices, said,

and treat them as second-grade citizens in party affairs, especially when it
